Operator: Barbad Musical Instruments, a retail musical-instruments business operating in the UAE (referred to below as “Barbad”, “we”, “us” or “our”).
Welcome — these Terms & Conditions (“Terms”) govern your access to and use of barbadpiano.ae and any purchase of products or services from us. By using the website or placing an order you agree to these Terms. If you do not agree, please do not use the site or place orders.
1. Definitions
- Products: musical instruments, accessories, strings, straps, cases, parts, and related goods sold on the Website.
- Services: delivery, tuning, installation, repair, warranty support, and any other paid or complimentary services we offer.
- Customer / You: any person or business that visits the Website or purchases Products/Services.
2. Orders & Contract Formation
- All orders placed on the Website are subject to acceptance by Barbad. After you place an order you will receive an order confirmation email; this does not constitute acceptance. Acceptance occurs when we send a separate shipping confirmation or when we deliver the Product.
- We reserve the right to decline or cancel any order for reasons including product unavailability, pricing errors, suspected fraud, or failure to obtain authorization for payment.
- Prices displayed are in UAE Dirhams (AED) unless otherwise stated. All prices shown may include VAT where indicated.
3. Payment
Accepted methods: major credit/debit cards (Visa, Mastercard, American Express), Apple Pay / Google Pay / Samsung Pay , Amex , JCB , Unionpay and bank transfer for bulk or corporate purchases (contact support for details).
- Payments are processed through secure third-party payment gateways. Card details are encrypted; we do not store full card data on our servers.
- Payment must be received in full before we dispatch products (unless another arrangement has been agreed).
- If a payment is declined or chargeback occurs, we may refuse further orders and seek recovery of costs.
4. Promotions, Discounts & Gift Cards
- Promotional offers (percentage discounts, free shipping, bundle deals) are valid only during the promotion period and only on qualifying items specified in the promotion. Barbad reserves the right to modify or end promotions at any time.
- Discount codes cannot usually be combined unless explicitly stated.
- Gift cards (if issued) are subject to their own terms (expiry, non-refundable, cannot be converted to cash unless required by law).
5. Shipping & Delivery
- We provide local delivery within the UAE and international shipping to selected countries. Delivery costs and estimated delivery times are shown at checkout.
- Complimentary services: Barbad offers first-time free delivery for qualifying piano purchases (terms apply) and first-time complimentary tuning & regulation on acoustic pianos delivered by us — claimable once within a specified period after delivery. These benefits are non-transferable and subject to eligibility (please see Shipping & Services pages or contact support for exact details).
- For pianos and large items we use specialist carriers and careful packing; customers must inspect the item at the time of delivery and note any visible damage on the carrier document.
- If no one is available to receive the delivery, the item may be returned to the depot and additional re-delivery fees may apply.
6. Acceptance, Inspection & Reporting Problems
- For fragile, large, or high-value goods (pianos, grands, etc.) you must inspect for damage and notify us within 48 hours of delivery for visible damage or incorrect items. For other items, notify us within 7 days of receipt.
- To report damaged, defective, or incorrect items, email support with order number, description, and photos. We will arrange collection, replacement, repair, or refund as appropriate.
7. Returns, Refunds & Exchanges
- Accessories & small items: Unused, unopened items may be returned within 14 days of delivery for a refund or exchange, unless marked non-returnable.
- Electronics, amplifiers, and digital instruments: May be returned within 14 days if unused and in original packaging, subject to a restocking fee for opened items if specified at the time of purchase.
- Pianos and custom/modified instruments: Due to the size and bespoke nature, pianos are non-returnable except for manufacturing defects or damage upon delivery. For these items, you must notify us within 48 hours and allow inspection.
- Custom orders, altered, or special-order items are non-refundable unless faulty.
- Refunds, once approved, are processed back to the original payment method within 7–14 business days (time may vary by payment provider). COD refunds may be issued as store credit or bank transfer at our discretion.
- Return shipping costs are the customer’s responsibility unless the return is due to our error (damaged/incorrect item) or otherwise stated (e.g., promotional free returns).
8. Warranties & Repairs
- Products may carry manufacturer warranties. Warranty terms (duration and coverage) vary by brand — consult the product listing or warranty card included.
- Barbad also provides certain after-sales services (tuning, regulation, minor adjustments). First-time tuning/regulation for pianos delivered by Barbad is complimentary once; subsequent tunings are paid services.
- Warranty does not cover damage from misuse, normal wear and tear, accidental damage, or unauthorized repair/alteration.
- For warranty claims, provide proof of purchase and follow our claims process.
9. Price Errors & Availability
- We aim to keep prices and stock accurate, but mistakes may occur. If an item is priced incorrectly due to typographical error or system fault, we may cancel the order and issue a refund.
- Items shown as “in stock” may become unavailable; we will inform you and offer an alternative, backorder option, or refund.
10. Intellectual Property
- All content on the Website (text, images, logos, audio, video) is owned or licensed by Barbad and protected by IP laws. You may not reproduce, distribute, or use our content for commercial purposes without permission.
11. User Accounts, Reviews & Conduct
- If you create an account you are responsible for keeping your password secure and for activity under your account.
- Reviews, photos, or other content you submit may be used by Barbad for marketing; by submitting you grant us a license to use it (non-exclusive, royalty-free).
- Do not post unlawful, abusive, defamatory, or infringing content. We may remove content and suspend accounts at our discretion.
12. Privacy
- Our Privacy Policy explains how we collect and process personal data. By using the Website and ordering you consent to the collection and use described in that policy.
13. Limitation of Liability & Disclaimer
- To the fullest extent permitted by law, Barbad’s liability for any direct loss arising from purchases is limited to the purchase price paid for the relevant Product.
- We are not liable for indirect, incidental, consequential, or punitive losses (including loss of business, income, profits, data) except where such limitation is prohibited by applicable law.
- Products are sold “as is” to the extent permitted; specific product performance and suitability are the buyer’s responsibility.
14. Force Majeure
- We are not liable for failure or delay caused by events beyond our reasonable control (natural disasters, strikes, transport disruptions, customs delays, acts of government, pandemics, etc.). In such cases we will try to inform affected customers and offer alternatives where possible.
15. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the United Arab Emirates. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise agreed in writing.
16. Changes to Terms
- Barbad may amend these Terms at any time. Changes take effect when posted on the Website. For material changes we will attempt to notify registered customers by email.
