These Terms & Conditions (“Terms”) govern access to and use of barbadpiano.ae and the purchase of products and services from Barbad Musical Instruments (“Barbad”, “we”, “us” or “our”), a UAE-based musical instrument retailer and service provider.
By placing an order, purchasing or requesting a paid service, or otherwise entering into a transaction with Barbad through the Website, you agree to these Terms. Please read them before completing a purchase.
Nothing in these Terms excludes or limits any consumer right or remedy that cannot lawfully be excluded or limited under applicable UAE law.
1. Definitions
In these Terms, the following words have the meanings set out below unless the context requires otherwise.
- Website: barbadpiano.ae and the webpages, online-store functions, and features operated by Barbad through that domain.
- Products: musical instruments, accessories, parts, equipment, and other goods offered for sale by Barbad.
- Services: delivery, installation, piano tuning and regulation, maintenance, repair, warranty coordination, and other services offered by Barbad from time to time.
- Customer / You: any person or legal entity that accesses the Website, places an Order, purchases a Product, or requests a Service from Barbad.
- Order: a request submitted to Barbad to purchase one or more Products or Services, subject to acceptance in accordance with these Terms.
- Consumer: where this term is used in these Terms, a person entitled to consumer protections under applicable UAE law.
2. Orders & Contract Formation
Products and Services displayed on the Website are invitations to place an Order and are subject to availability. Submitting an Order does not by itself guarantee that the Order has been accepted by Barbad.
After an Order is submitted, the Customer may receive an automated acknowledgement, payment notification, or order confirmation generated by the Website. Unless Barbad expressly states otherwise, an automated acknowledgement does not by itself constitute final acceptance of the Order.
- product or service availability;
- accuracy of pricing, product information, and Order details;
- successful payment or payment authorization;
- delivery or service availability for the relevant location;
- reasonable fraud, security, or verification checks; and
- any other requirement reasonably necessary to complete the transaction lawfully.
Barbad may decline or cancel an Order before acceptance where reasonably necessary, including where a Product is unavailable, information or pricing contains a genuine error, payment cannot be authorized, the Order cannot reasonably be fulfilled, or there is a reasonable concern regarding fraud, misuse, or unlawful activity.
If Barbad does not accept an Order after payment has already been collected, any amount due back to the Customer will be refunded in accordance with applicable law and the relevant payment method.
Nothing in this section limits any mandatory right or remedy available to a Consumer under applicable UAE law.
3. Prices, VAT & Payment
Unless otherwise stated, prices displayed on the Website are in UAE Dirhams (AED). Where VAT is applicable, displayed prices will include VAT to the extent required by UAE law.
Delivery, installation, special handling, or other charges that are not included in the displayed Product price may be charged separately. Any such applicable charges will be displayed or communicated as part of the Order process before the Customer is required to complete payment.
Barbad may make different payment methods available through the Website from time to time. Available payment methods may vary depending on the Order, transaction value, payment provider, or other relevant circumstances.
The Customer is responsible for providing accurate billing and payment information and for ensuring that the payment method used is authorized for the transaction.
An Order may remain subject to payment authorization, verification, and successful receipt of the required payment. Where payment is declined, reversed, incomplete, or cannot reasonably be verified, Barbad may delay acceptance or fulfilment of the Order or decline the Order, subject to applicable law.
If an amount has been incorrectly charged or an Order is not accepted after payment has been collected, any amount properly due back to the Customer will be handled in accordance with applicable law and the relevant payment method.
- every payment method will always be available,
- prices can never contain genuine technical errors,
- a fixed refund-processing timeframe,
- or that every displayed price is necessarily subject to VAT.
4. Promotions & Discounts
Barbad may offer promotions, discounts, promotional codes, bundles, or other special offers from time to time. Any such offer may be subject to specific eligibility criteria, validity periods, Product exclusions, quantity limits, or other conditions communicated with the offer.
Unless otherwise stated, promotional offers cannot be combined with other discounts or promotions and have no cash value.
Barbad may correct, withdraw, suspend, or amend a promotion where reasonably necessary, including in the event of a genuine pricing or technical error, misuse, fraud, stock limitations, or circumstances outside Barbad’s reasonable control, subject to applicable UAE law.
Promotional pricing and advertising will be handled in accordance with applicable UAE legal and regulatory requirements, including any approval or licensing requirements that may apply to promotions or general price discounts.
Nothing in this section limits any mandatory consumer right or remedy available under applicable UAE law.
5. Shipping & Delivery
Barbad offers delivery within the UAE to locations and addresses that can reasonably be served by its delivery methods or delivery partners. Availability of delivery may depend on the Product, destination, access conditions, and any special handling or installation requirements.
Delivery charges, installation charges, and any other applicable logistics costs will be displayed or communicated during the Order process where relevant.
Any delivery date or timeframe provided by Barbad is an estimate unless a specific delivery commitment has been expressly confirmed. Delivery times may be affected by Product availability, payment verification, delivery location, access requirements, third-party carriers, weather, traffic, public restrictions, or other circumstances outside Barbad’s reasonable control.
The Customer is responsible for providing an accurate and accessible delivery address and reasonable information required to complete delivery. For large, heavy, fragile, or specialized instruments, Barbad may request information concerning building access, stairs, lifts, doorways, parking, loading access, or other relevant site conditions before arranging delivery.
If delivery cannot reasonably be completed because of inaccurate information, unavailable access, absence of an authorized recipient, or another circumstance attributable to the Customer, Barbad may arrange redelivery or another reasonable solution. Any additional charge that may apply will be communicated before the additional service is provided, subject to applicable law.
Where a delivery delay, failure, damage, incorrect supply, or other delivery issue gives the Customer a mandatory right or remedy under applicable UAE law, nothing in this section limits that right or remedy.
6. Receiving Orders & Reporting Delivery Problems
Customers should reasonably inspect delivered Products as soon as practicable after receipt, particularly for visible damage, missing items, incorrect Products, or other apparent delivery issues.
If a Product is damaged, incomplete, incorrectly supplied, or materially different from the confirmed Order or Product description, the Customer should contact Barbad as soon as reasonably possible after discovering the issue.
- Order number or proof of purchase.
- Product name and, where relevant, model or serial number.
- A description of the issue.
- Photographs or video where reasonably useful to show damage, packaging condition, missing items, or incorrect supply.
Customers should retain the Product, packaging, supplied accessories, and relevant delivery materials where reasonably possible until Barbad has had an opportunity to assess the reported issue or provide further instructions.
The Customer should not arrange an unauthorized return, repair, alteration, or disposal of a Product before Barbad has had a reasonable opportunity to assess the issue, unless otherwise necessary or permitted by applicable law.
Failure to report an issue immediately does not by itself remove any mandatory right or remedy that remains available to the Customer under applicable UAE law.
7. Returns, Refunds, Repairs & Replacements
Returns, refunds, repairs, replacements, cancellations, and related remedies are handled in accordance with Barbad’s Refund & Returns Policy and applicable UAE law.
Depending on the circumstances, a Customer may be entitled to repair, replacement, return, refund, or another remedy where a Product is defective, damaged, incomplete, incorrectly supplied, or otherwise does not conform to the Order or applicable legal requirements.
Any discretionary return or exchange of a non-defective Product is subject to the conditions stated in Barbad’s Refund & Returns Policy and any specific terms communicated in connection with the relevant Product or Order.
Nothing in these Terms or in the Refund & Returns Policy excludes or limits any mandatory right or remedy available to a Consumer under applicable UAE law.
8. Warranties & After-Sales Services
Certain Products may be covered by a manufacturer, distributor, supplier, or other applicable warranty. Warranty coverage, duration, procedures, and exclusions may vary by Product and brand.
Where applicable, Barbad may assist with warranty assessment, repair coordination, replacement, spare parts, maintenance, or referral to an authorized service provider, depending on the Product, the nature of the issue, the applicable warranty terms, and UAE law.
Warranty or after-sales support may reasonably require proof of purchase and, where relevant, the Product model, serial number, photographs, video, inspection, or other information needed to assess the issue.
Damage or malfunction resulting from misuse, accident, unauthorized alteration or repair, unsuitable environmental or storage conditions, failure to follow applicable operating or care instructions, or normal wear and tear may fall outside an applicable manufacturer or supplier warranty, subject always to any mandatory rights available under UAE law.
Services such as piano tuning, regulation, maintenance, adjustment, installation, or repair may be subject to separate service terms or quotations communicated before the relevant Service is provided.
Any manufacturer, distributor, or supplier warranty is additional to and does not replace or limit any mandatory consumer right or remedy available under applicable UAE law.
9. Product Information, Availability & Website Errors
Barbad aims to keep Product descriptions, specifications, images, pricing, availability, and other Website information accurate and up to date. However, minor differences may occur, including differences in colour, finish, appearance, packaging, or manufacturer specifications.
Product images are provided for identification and illustration purposes. Actual appearance may vary depending on lighting, screen settings, production changes, natural materials, or manufacturer updates.
Product availability may change without notice. Display of a Product on the Website does not guarantee that it will remain available until an Order has been accepted and fulfilled.
If Barbad identifies a genuine error in Product information, pricing, availability, or other material Order details before acceptance, Barbad may correct the information and contact the Customer where appropriate before proceeding with the Order.
Barbad will not knowingly use false, deceptive, or misleading Product descriptions or advertising. Where a Product supplied is materially different from the confirmed Order or description, any applicable remedy will be handled in accordance with UAE law and Barbad’s Refund & Returns Policy.
Nothing in this section permits Barbad to avoid any mandatory obligation relating to accurate Product information, advertising, conformity, or consumer remedies under applicable UAE law.
10. Website Use & Intellectual Property
The Website and its content, including text, graphics, logos, branding, photographs, product images, design elements, page layouts, and other materials, may be protected by copyright, trademark, and other intellectual property rights belonging to Barbad, its suppliers, manufacturers, licensors, or other rights holders.
Customers may access and use the Website for personal or legitimate commercial purchasing purposes. No ownership or intellectual property rights are transferred merely by accessing the Website or purchasing a Product.
Unless permitted by law or authorized by the relevant rights holder, Website content must not be copied, reproduced, republished, distributed, modified, commercially exploited, or used in a manner that infringes intellectual property rights.
Product names, brand names, trademarks, logos, and other third-party materials displayed on the Website remain the property of their respective owners. Their appearance on the Website does not imply that Barbad owns those third-party rights.
Customers must not knowingly use the Website in a manner that is unlawful, fraudulent, harmful, disruptive, or intended to interfere with the Website’s operation, security, or other users.
Nothing in this section restricts any use of Website content that is expressly permitted by applicable law.
11. Liability, Events Outside Our Control & Mandatory Rights
To the extent permitted by applicable law, Barbad will not be responsible for loss, damage, delay, or additional cost to the extent caused by circumstances attributable to the Customer, including misuse of a Product, failure to follow applicable care or operating instructions, inaccurate information supplied by the Customer, unauthorized alteration or repair, or failure to provide reasonable delivery access.
Barbad will also not be responsible, to the extent permitted by law, for delay or failure caused by events outside its reasonable control, including transport disruption, severe weather, government action or restrictions, interruption of utilities or communications, supply-chain disruption, acts or omissions of third parties outside Barbad’s reasonable control, or other force-majeure or exceptional circumstances.
Where such circumstances temporarily affect Barbad’s ability to perform an obligation, performance may be delayed or suspended to the extent reasonably necessary while the relevant circumstances continue, subject to applicable law.
Nothing in these Terms excludes or limits liability, rights, or remedies where exclusion or limitation is prohibited by applicable UAE law.
In particular, nothing in these Terms limits any mandatory consumer protection relating to defective or non-conforming Products, misleading information, warranties, refunds, repairs, replacements, delivery obligations, or other rights provided by applicable law.
12. Governing Law, Changes to These Terms & Contact
These Terms and transactions entered into through the Website are governed by the laws in force in the United Arab Emirates, subject to any mandatory law that applies to the particular transaction or Customer.
Any dispute arising from or relating to these Terms, an Order, a Product, or a Service will be subject to the jurisdiction of the competent courts in the United Arab Emirates, unless applicable law requires otherwise.
Barbad may update these Terms from time to time to reflect changes to the Website, business practices, Products or Services, or applicable legal and regulatory requirements. The revised Terms will apply from the effective date stated on the Website.
Unless required or permitted by applicable law or agreed with the Customer, a later version of these Terms will not retrospectively alter the terms applicable to a transaction that was already concluded before the revised Terms took effect.
